Ministry underscores aid to citizens abroad

What the relevant Cambodian ministries should have done in the first place would have been to restrict or review aspects of this migration phenomenon as a whole. Neither young men nor young women are quite safe from abuse and other forms of exploitation once they will have found themselves on an isolated high-sea fishing boat or enslaved at the walled residence of their foreign employers. In recent years the nightmare tales reported of many a young Cambodian woman falling victims to brutality and abuse at the hands of their Malaysian employers in this Asean member country should have provided ample warning, but the recent agreement to allow more of them to enter the domestic maid market in Saudi Arabia - a far-flung country with whom Cambodia has little to no firm diplomatic relations, and an Islamic culture that is even more orthodox and repressive as regards human rights than is the case with Malaysia - is nothing short of baffling and inhumane. As they often say, prevention is better than cure. 

These decision makers and ministers should also be asking themselves this basic question: Would I be prepared to let my sons or daughters face the same risks and elements?

Ministry underscores aid to citizens abroad

The Ministry of Foreign Affairs assisted in the repatriation of 196 Cambodian citizens in the first half of 2016, according to a statement released this week.

The statement followed a Post story last week that revealed a maid had fled Saudi Arabia without assistance after suffering abuse.

Among the rescued citizens were 29 women from China, mostly married to Chinese men; 57 fishermen from Indonesia; and 65 workers from Malaysia.

“The evaluation of [its] activities to help overseas workers should be based on the actual work of the ministry . . . not based on an unrelated case or one that happened through lack of communication with the ministry,” the statement reads.

Earlier this year, a domestic worker was repatriated from Saudi Arabia after her relatives contacted the Cambodian Embassy in Kuwait. Cambodia does not have an embassy in Saudi Arabia, but an MoU on domestic workers was signed between the two countries in February.

Floods affect Mondulkiri; Ratanakkiri at risk: gov’t

Heavy rains have damaged roads and several houses in Mondulkiri province’s Koh Nhek district, while Ratanakkiri province’s Lumphat district is faced with possible flooding as the inclement weather continues, local authorities said yesterday.
Klot Vuthea, deputy chief of Koh Nhek district police, said that after three days of heavy rains, two roads – one in Rayum commune, one in Nang Khylek commune – had flooded, with each damaged at many points. In addition, floods affected about 30 houses in the low-lying communes.
“Many hectares of farms and paddy fields were also flooded, but there is no damage yet,” Vuthea said.
Agriculture experts have said that if a flood lasts less than a week, the plantings will be fine; if more than a week, the rice will begin to spoil.
In Ratanakkiri, Lumphat district acting police chief Klol Thoeung said that four villages located in Chey Uddom commune are at risk of being flooded should the rains continue, since the water levels in the area are already high.
“The climate remains stuffy, and if it [continues to] rain, the four villages located next to the O’kan River will gradually start to flood,” Thoeung said.

Fishing Industry, Green Experts Express Concern About Paper Plant in South Vietnam

Vietnam’s fishing industry and environmental experts have expressed concern about the waste treatment system of a new paper plant in Hau Giang province in southern Vietnam’s Mekong Delta region, fearing it could discharge contaminated effluents that harm the area and kill fish.

Their concerns come about three months after a mass fish kill that some believe resulted from the discharge of contaminated effluents by another factory in the central coastal provinces. The fallout from tons of dead fish floating ashore included rare mass protests over lost livelihoods.

The Vietnam Association of Seafood Exporters and Producers (VASEP), which fears that the U.S. $1.2 billion paper plant scheduled to begin operations in August will cause environmental pollution and contaminate seafood in the area, has asked the Ministry of Natural Resources and Environment to assess the situation, according to Vietnam’s Dan Tri International news website.

The ministry in turn has asked the local environmental agency and police to inspect the plant’s waste treatment system to ensure it adheres to laws and regulations. It will also ask experts to inspect the system and scrutinize its trial operation plan and waste treatment monitoring situation, the news agency said.

The sea breeze found us on a fast boat bound for Ly Son Island, located about 15 nautical miles off Vietnam’s Central Coast. For centuries, the island has served as a base for their fishermen to venture into the dangerous Paracels Archipelago.

On board, marine scientist Dr. Chu Manh Trinh described to me the urgent need for a clarion call to all South China Sea claimants to join forces in tackling environmental offshore degradation and the depletion of natural resources through ecological science and cooperation.

“The healthy coral reefs in Cu Lao Cham are protected and are key centers in distributing nutrition into the sea and act as breeding grounds for fish species, and we need more marine protected areas,” he said.

A Fulbright scholar, Trinh intends to adopt the same conservation model in Ly Son. He plans on working in partnership with the private sector in creating a geopark that encompasses a marine protected area. Since the island’s bedrock represents many changes in the Earth’s crust, including basalt layers formed from a 10-million-year-old volcano, there’s hope that that it may be recognized as a global geopark by the United Nations Educational, Scientific, and Cultural Organization (UNESCO).

Vietnamese activists and bloggers have expressed doubts that the government will be fully transparent about the results of its investigation of mass fish deaths that began three months ago along the country’s central coastal provinces, when officials publicly disclose their findings on Thursday.

Government experts have claimed that a “red tide,” or a release of dangerous chemicals by humans, caused at least 100 tons of dead fish to begin washing ashore in Ha Tinh, Quang Binh, Quang Tri, and Thua Thien-Hue provinces in early April.

But ordinary folks believe that wastewater runoff from a huge steel plant run by Formosa Ha Tinh Steel Corporation, a subsidiary of Formosa Plastics Corporation of Taiwan, poisoned the fish.

Though the company has denied responsibility, the incident sparked rare protests in Vietnam, as well as in Taiwan, over lost livelihoods and environmental damage.

Nguyen Hue Chi, a scholar who runs a website devoted to bauxite production and mining, told RFA’s Vietnamese Service that the airing of a documentary about the incident on Taiwanese television has raised many questions about Formosa’s role in the environmental disaster.

Cambodian opposition leader Sam Rainsy on Wednesday accused Prime Minister Hun Sen of using the judiciary to crush the opposition and guarantee his own victory in 2018 elections while the country goes "down the drain" amid rampant corruption.

Speaking to Reuters in Manila, where he spends some of his time since he went into his latest period of self-imposed exile, Rainsy said he still hopes to strike a political deal with his nemesis. He said he will definitely return home just before local elections in June next year.

"Hun Sen himself realizes that he is losing ground, that the popular support the opposition enjoys is growing," Rainsy said during a break from a meeting with nearly 60 key members of his Cambodia National Rescue Party (CNRP), most of whom had flown into the Philippines' capital overnight.

"So he wants to disrupt the election process by creating an atmosphere of fear and intimidation ... This is just intimidation and an attempt to frighten the whole population not to support the opposition."

Government spokesman Phay Siphan could not be reached for comment on Wednesday.
The spokesman for Hun Sen's Cambodian People's Party denied that the government or the party uses the judiciary for political ends.

"The cases against people at the CNRP are criminal wrongdoings, and they must be held responsible before the law," said Sok Eysan, adding that Rainsy should not hope for a political deal before the 2017 vote.

Military-ruled Thailand on Tuesday lost out to Kazakhstan by a wide margin of votes in its campaign to win a non-permanent seat on the U.N.’s prestigious Security Council.

Thailand received only 55 votes out of 193 votes cast by all of the members of the U.N.’s General Assembly, according to information released by the United Nations.

At least 138 member-states voted for Kazakhstan to become the next non-permanent representative for Asia on the Security Council, General Assembly President Mogens Lykketoft said in reading out the vote tally, which was broadcast on U.N. television.

Like Thailand under the junta, Kazakhstan, a central Asian republic and former Soviet state, has been the focus of international criticism for its human rights record and authoritarian style of rule. Starting in January 2017, Kazakhstan for the next two years will occupy the regional seat on the council held by Malaysia.

Fire razes 33 homes in Phnom Penh

Thirty-three houses were destroyed and two damaged in a fire yesterday in Phnom Penh’s Meanchey district, as fire engines were unable to access the site due a narrow approach road.

Police were alerted by villagers to the fire, which took place in Boeung Tompun commune’s Tnot Chrum village, but could not reach it in time because their fire trucks were too big for the road leading to the village.

“There were no injuries or deaths in this fire,” said Teng Sino, Meanchey district’s police chief. “Our authorities are investigating the cause of the fire.”

According to the police, the fire affected 78 families who lived in the small wooden huts.

A final draft of a casino law has been submitted to the Vietnamese government which, if approved, could lift the ban on Vietnamese nationals gambling on their home turf – a move that some casino operators in the Cambodian border town of Bavet say could be a knockout blow to their struggling operations.

While the legislation’s details have not been publicly released, Lim Kim Seng, chairman of Lucky89 Group, which operates two casinos along the Vietnamese border, said its passage would deeply undermine Bavet’s allure to Vietnamese gamblers.

“We have been worried about this law for a long time and we hope that the Vietnam government won’t let its [citizens gamble on home soil], as this would dramatically affect our business,” he said.

He claimed the border town has already seen slower growth as the number of Vietnamese cross-border excursions has declined in recent years.

“The vast majority of our players and revenue come from Vietnam, and if they continue to stop coming to Bavet the sector will face a lot of challenges to remain profitable,” he said. “It’s already not easy for Cambodian casinos here.”

NGO releases ELC figures to help with ‘shortcomings’

The NGO Forum yesterday released an extensive and updated accounting of economic land concessions (ELCs) in the Kingdom, suggesting that in a 20-year period, 267 ELCs totalling 1,532,783 hectares were granted.

In a statement announcing the data’s release, the NGO Forum said it had been compiled in hopes the government could use it to address “shortcomings” in the ELC process.

The data collection, from 1995 to the end of 2015, was conducted by the Research Advocacy and Communication Centre, and found that land disputes arising from ELCs had affected 35,000 families in Cambodia, with most of the ELCs found in Kratie province.

Turkish investigators pored over video footage and witness statements on Wednesday after three suspected Islamic State suicide bombers opened fire and blew themselves up in Istanbul's main airport, killing 41 people and wounding 239.

The attack on Europe's third-busiest airport was the deadliest in a series of suicide bombings this year in Turkey, part of the U.S.-led coalition against Islamic State and struggling to contain spillover from neighboring Syria's war.

President Tayyip Erdogan said the attack should serve as a turning point in the global fight against terrorism, which he said had "no regard for faith or values". U.S. President Barack Obama and Russian President Vladimir Putin condemned it in separate phone calls with Erdogan, his office said.

Five Saudis and two Iraqis were among the dead, a Turkish official said. Citizens from China, Jordan, Tunisia, Uzbekistan, Iran and Ukraine were also among the 13 foreigners killed.

One attacker opened fire in the departures hall with an automatic rifle, sending passengers diving for cover and trying to flee, before all three blew themselves up in or around the arrivals hall a floor below, witnesses and officials said.

Prominent Boeung Kak land rights activist Yorm Bopha has again been found guilty of organising the beating of two motodops in 2012, this time by the Court of Appeal, but will not face any additional jail time.

Bopha, 32, spent a year and eight days behind bars after originally being found guilty and sentenced to three years in prison over the attack.

However, following an international campaign seeking her release, in November of 2013, the Supreme Court ordered Bopha be granted bail and the case sent to the Appeal Court.

Bopha was yesterday once again sentenced to three years in prison, but the remainder of the sentence was suspended. She was also ordered to pay the victims 10 million riel (about $2,500). No reasoning was provided in court for the verdict.

Bopha’s ex-husband, Lous Sakhon, who had already received a three-year suspended sentence for the beatings, also was ordered to pay 10 million riel. The pair was originally fined a total of 60 million riel.

After a month living in an office at his party's headquarters to avoid arrest, Cambodian opposition leader Kem Sokha remains defiant and said Prime Minister Hun Sen is scared of losing the 2018 election.

Kem Sokha called for "national reconciliation" talks to end a crisis that both he and the self-styled strongman, Hun Sen, have warned could nudge the Southeast Asian nation into political conflict.

Tension has risen as Sokha and other opposition members face legal charges they say are trumped up by a judiciary in thrall to Hun Sen. The prime minister was intimidating the opposition in an attempt to avoid a rerun of a 2013 election that nearly cost him the premiership, Sokha said.

"What he is scared of most is defeat in the election," Sokha told Reuters in his first interview since he holed up at the party headquarters on May 26. "His strategy is to remove the opposition party leadership, so now he is targeting me."

Sokha became the acting head of the Cambodia National Rescue Party (CNRP) when the party's leader, Sam Rainsy, was forced into exile late last year, also to avoid arrest.

The number of traffic accidents involving workers is down 28 per cent in the first six months of 2016 compared to the same period last year, the Ministry of Labour’s National Social Security Fund (NSSF) reported yesterday.

Accidents for 2016 through June totalled 2,259, with 2,849 deaths and injuries. This compares to 3,122 accidents and 3,427 casualties a year ago.

In addition to decreased accidents, figures across the NSSF’s three categories of casualties showed declines as well, noted NSSF spokesperson Cheav Bunrith. Deaths dropped 40 per cent, from 70 to 42, over the same period, while serious injuries tumbled 20 per cent to 412, and light injuries declined 16 per cent to 2,395.

Moto accidents were the most common, with 1,591 cases and 29 deaths between January and June, followed by 371 car accidents accounting for seven deaths.

A rice farmer from Svay Rieng province yesterday told the Khmer Rouge tribunal of his time as a Khmer Rouge spy who fled a vicious purge, ultimately defecting to the Vietnamese forces he was once tasked with monitoring.

Chhun Samorn, now in his late 50s, joined the Khmer Rouge as a messenger, and in 1976 was transferred to a special unit within the East Zone to gather intelligence on Vietnamese troops at the border.

“Wherever there were Vietnamese soldiers, I went there to collect intelligence information . . . about their bases, about their weaknesses and strengths, so we could plan our attack,” Samorn said.

But in 1978, after intense clashes at the border, Khmer Rouge soldiers from the capital and the Southwest Zone arrived and told troops in the Eastern Zone to lay down their guns and reveal where land mines were planted, before telling them they would be sent to Phnom Penh and re-armed.

Instead, the soldiers were loaded onto a truck and taken to a site at a farm rice, where they saw a fellow Eastern Zone cadre who had disappeared. “Then we knew that this was a lie.”

The Ministry of Economy and Finance announced on Monday that the government will block all illegal rice imports at its borders and limit legal rice shipments from Vietnam based on production cost.

As part of the new regime, only milled rice with a production cost of $300 to $600 per tonne can legally be imported from Vietnam. The goal, according to the ministry, is to eliminate cheap Vietnamese rice that sells for $200 or less per tonne from the Cambodian market.

The ministry also requires identifying features, such as the name of the rice producer, rice variety and any trademarks, to be visible on imported packages in order to assess its true cost.

Moul Sarith, secretary-general of the Cambodian Rice Federation (CRF), the industry body representing the Kingdom’s rice millers and exporters, said the new policy would help Cambodia’s struggling rice sector survive amid an onslaught of cheap Vietnamese milled rice.

“This mechanism will control the flood of rice imports from Vietnam as well as rice smuggling,” he said yesterday. “It will also control the quality rice in the market.”

Prime Minister Hun Sen yesterday accused foreign states of bullying Cambodia over its position on the South China Sea dispute while also lashing out at criticism that the country had descended into a “political crisis”.
The premier delivered the speech to about 10,000 Cambodian People’s Party members at an event celebrating the 65th anniversary of the creation of the ruling party, which links its birth to the establishment of a Cambodian Communist Party in 1951.
Since its incarnation as the CPP for the 1993 elections, the party and its leader have repeatedly been criticised for using the judiciary to attack political opponents.
Most recently, with the 2017 commune ballot approaching, a string of legal cases has been brought against the opposition Cambodia National Rescue Party, including its president, Sam Rainsy, who has again fled into self-exile, and its deputy, Kem Sokha, who is holed-up in his party’s headquarters to avoid arrest.
However, speaking yesterday at his party’s headquarters, the prime minister sought to cast the government as the victim of political agendas, both domestically and internationally.
“Cambodia does not suffer any crisis,” he told the crowd, according to a copy of his speech. “Efforts by some people to make noise that the country is in crisis or political tension is in fact a dishonest trick to deceive public opinion.

The trial of three activists from environmental group Mother Nature, charged with threatening to damage sand-dredging equipment, wrapped yesterday at Koh Kong Provincial Court, with the judge setting July 1 for a verdict.

San Mala, 24, Try Sovikea, 26, and Sim Somnang, 29, have been in pretrial detention since August in the high-profile case, which critics say is being pursued to stifle protests against the province’s lucrative sand-mining industry.

The trio – charged with “making a threat followed by an order” – was arrested following a campaign in July last year, which saw activists board dredging vessels in a bid to push them from the area’s mangrove estuaries.

In court on Monday, the plaintiffs, including a district deputy governor and an employee from sand-mining company Direct Access, whose ships were boarded, accused the protesters of threatening to burn the equipment.

According to a court monitor at the hearing, the second and final day of hearings yesterday began with further cross examination of the accused, who deny the charge, which carries a maximum two-year jail term.

The United States has downgraded Myanmar in its annual human trafficking report, citing the Southeast Asian nation’s failure to reduce the practice of using child soldiers primarily by the government army, the head of Myanmar’s anti-human trafficking force said Tuesday.

“The U.S. pointed out some points that we police have been working on. It also pointed out the child soldier issue, which the military is working on,” said Lieutenant Colonel Thet Naung, national head of the police Anti-Human Trafficking Team.

The U.S. State Department’s Trafficking in Persons (TIP) report, to be released Thursday, ranks 188 countries on how they handle human trafficking and assigns them one of four rankings—Tier 1, Tier 2, Tier 2 Watch List, and Tier 3—based on whether they meet the minimum standards for the elimination of human trafficking, as mandated by the Trafficking Victims Protection Act (TVPA).

The minimum standards under the U.S. law include a government’s prohibition of and punishment of severe forms of human trafficking, and serious and sustained efforts to eliminate such trafficking.

Myanmar’s use of child soldiers was also cited in last year’s TIP report.

“Some military personnel and some armed ethnic groups continue to be involved in the recruitment and use of child soldiers, particularly in conflict-prone ethnic areas,” the 2014 TIP report said.

Brushing off pressure from Hanoi to pick someone else, the South Korean May 18 Memorial Foundation gave Vietnamese doctor and dissident Nguyen Dan Que its 2016 Gwangju Prize for Human Rights. The award is a recognition of "individuals, groups or institutions in Korea and abroad that have contributed in promoting and advancing human rights, democracy and peace through their work.” 

In Que’s case, he has a vast body of work that includes the founding of the pro-democracy and nonviolent National Progressive Front and High Tide of Humanism movement, which advocates for basic human rights and free elections. He also co-founded the Vietnamese Blogger Network and the Former Vietnamese Prisoners of Conscience organization to continue pushing for human rights and democracy in Vietnam. Even when given the opportunity to leave the country, he chose to stay through imprisonment, hard labor, torture, and house arrest.

He was unable to accept the award in person because the Vietnamese government refuses to allow Que to travel outside Saigon where he lives. He shared the award with the Malay election reform organization Bersih 2.0. Que discussed the award and the democracy movement in Vietnam with RFA’s Vietnamese Service reporter Gia Minh.

Development assistance provided to Vietnam by foreign governments and banks helps to support security forces repressing the Vietnamese people and should be tied in future to improvements in the one-party communist state’s rights record, a group of six Vietnamese civil society organizations said in an open letter this week.

Much of that money is also lost to corruption, the group said in its June 20 letter sent to the World Bank, the International Monetary Fund, the Asian Development Bank, the European Union, and the governments of Japan, Australia, and the United States.

In 2016, New York-based Human Rights Watch (HRW) reported Vietnam’s rights situation as “critical,” the group’s letter said.

“Rights activists and dissident bloggers face constant harassment and intimidation, including physical assault and imprisonment. Farmers have lost land to development projects without adequate compensation, and there is an absence of independent unions for workers.”

A Vietnamese family belonging to a Buddhist sect operating outside of government control was harassed this week by state-linked toughs in the run-up to the anniversary of the sect’s founding in 1939, the father of the family said on Wednesday.

Vo Van Buu, who follows an unsanctioned branch of the Hoa Hao Buddhist Church, told RFA’s Vietnamese Service that local authorities have blocked approaches to his family’s home in southwestern Vietnam's An Giang province, also sending men on motorbikes to intimidate and attack his wife and daughter.

“Since June 20, the government has deployed from 40 to 50 people to block both ways to my home,” Buu said. “They even put up a hammock in which to lie in front of the house.”

On Wednesday, as many as 70 men riding motorbikes also forced Buu’s wife, Mai Thi Dung, and daughter, Mai Thi Thuyet Linh, back to their home from a market about 10 kilometers away, Buu said.

A spokesman for Taiwan’s Ministry of Foreign Affairs has labelled as “absurd” China’s decision to suspend relations after Taiwan complained about China “capturing” 25 Taiwanese nationals accused of telecommunications fraud in Cambodia.

Cambodia on Friday deported the 25 Taiwanese and 14 Chinese nationals to China after they were arrested in Phnom Penh during a raid of an alleged voice over internet protocol (VoIP) scam targeting victims in mainland China.

An Fengshan, spokesman of China’s Taiwan Affairs Office, on Saturday said ties between the two countries were “currently in suspension” over the failure by Taiwan to recognise a 1992 consensus that endorses the “One China” principle, according to a statement posted on the office’s website.

The move to cut ties was in reaction to Taiwan’s opposition to Friday’s deportations, said Frances Lee, a spokeswoman for Taiwan’s Ministry of Foreign Affairs. She said such action was “absurd”, saying it was Taiwan who should be angry, not the other way around.

“They actually captured our nationals,” she said. “It’s irrational. We use rational ways to deal with our neighbours.”

Although he sent thousands to their deaths, former S-21 prison chief Kaing Guek Eav kept his own hands clean.

On his 12th and final day of testimony before the Khmer Rouge tribunal yesterday, Eav, better known as Duch, said despite overseeing the interrogation and execution of more than 12,000 people who were rotated through the prison, he took steps to ensure he didn’t personally end a life.

Nuon Chea defence lawyer asked Duch about an incident he mentioned during his testimony, in which he claimed Chea gave him potentially poisonous capsules to feed to prisoners, but Duch replaced the powder with paracetamol.

Koppe said he was puzzled by Duch’s account of swapping the powder in an apparent – and temporary – salvation for a handful of prisoners who were already marked for death.

“You were responsible for executing all these prisoners …What made you want to save these people?” Koppe asked. “I did not allow my hand to kill prisoners,” Duch said.

A Chinese state railway construction contractor has approached the government with a bid to conduct a feasibility study on connecting the capital’s river port to the Kingdom’s sole operating railway line, a state official said yesterday.

A representative of China Railway 16th Bureau Group met with Transportation Minister Sun Chanthol on Sunday to discuss a $250 million project proposal that would link the container terminal of Phnom Penh Autonomous Port (PPAP) to the Southern Line, a 266-kilometre rail line that stretches from Phnom Penh to Sihanoukville.

According to Chan Samleng, director of the railway department at the Ministry of Public Works and Transport (MPWT), the Chinese company’s proposal includes laying 42 kilometres of fresh railway from a spur on the Southern Line about 22 kilometres south of the capital.

“This is just one feasibility study for a proposed connection and we will wait to see the full details from the company before the ministry decides if it is economical,” Samleng said.

He added that while the linkage would allow the port’s LM 17 container terminal, located about 30 kilometres south of Phnom Penh on the Mekong River, to handle an increased volume of heavy containers, its necessity had yet to be determined.

Shots were fired as Stung Treng economic police failed to apprehend suspected illegal timber traders following a car chase on Sunday afternoon.

Hy Meach Chorum, deputy chief of the Stung Treng provincial economic crimes bureau, said officers fired five warning shots at a truck laden with luxury timber and a Toyota Camry, both of which were later impounded following a sting operation in Stung Treng town.

“Our officers confiscated an empty car and a truck filled with timber at around 1:20 on [Sunday] afternoon. The Camry had tried to keep our officers from stopping the truck transporting timber, so they shot the car first and then they shot the truck with the timber,” Chorum said. “[The suspected timber smugglers] fled into the forest . . . after we shot and the two cars got flat tyres.”

He went on to say that three police cars had taken part in the operation. The car and truck were handed over to local Forestry Administration officials before economic crimes police had a chance to count or catalogue the seized wood, Chorum added.
